BSC VII.T Vandalism and Destruction of Property Policy

Definition

Vandalism is defined as any willful or malicious behavior that causes damage to or destruction of BSC and/or private property.

Examples of vandalism include, but are not limited to, damage or destruction of BSC property or a member’s or guest’s personal belongings, unauthorized graffiti, damage to furniture, deliberate defacement of materials, buildings, sidewalks, walls, trees, furnishings, or the structure of a unit, fire safety violations, and/or the deliberate setting of illegal fires or bonfires, on BSC property, whether leased or owned. All vandalism is strictly prohibited and any person found responsible for vandalism will be subject to disciplinary and/or legal action.

Whenever culpability can be ascertained, repair or replacement costs will be assigned to the individual(s) responsible and/or the host of the guest(s) found responsible for the damage. If the individual responsible cannot be identified, the cost may be assigned to the unit unless the damage is reasonably deemed to be beyond the unit’s control.

Additionally, acts of vandalism that target individuals or groups on the basis of age, ancestry, color, religious creed (including religious dress and grooming practices), disability (mental and physical), HIV and AIDS status, marital status, medical condition (cancer and genetic characteristics), genetic information, military and veteran status, national origin (including language use restrictions), race, sex (including pregnancy, childbirth, breastfeeding, and medical conditions related to pregnancy, childbirth or breastfeeding), gender, gender identity and gender expression, sexual orientation, or any other protected status in accordance with all applicable federal, state and local laws, or destroy, tamper with, and/or remove signs that provide an accommodation for members, guests, alumni or third party contractors will result in disciplinary actions related to discriminatory behavior under the VII.B. BSC Antidiscrimination Policy, VII.C. BSC Harassment Policy, and/or VII.Q. BSC Anti-Bullying Policy.

Examples of discriminatory vandalism include, but are not limited to, destruction, tampering with, or theft of braille or gender-inclusive restroom signs and graffiti that uses language which is prohibited under the aforementioned policies.

Applicability

A violation of this policy will result in a range of sanctions up to and including, but not limited to a conditional contract, restitution, and/or membership termination.
