It is mutually agreed that it is the sole right of management to manage the BSC and to direct the working forces, subject only to the conditions expressly set forth herein. Management of the BSC includes determination of the type and scope of services, the number of houses to be operated and the methods, procedures and means of providing services. Direction of the working forces includes the rights of supervision in the employment relationship which shall be limited only by the express provisions set forth in this Contract.

A. BSC recognizes the BSC Employees as the bargaining agent for all BSC employees except member employees who are room and board or workshift compensated. Accordingly, the terms and conditions expressed in this agreement are explicitly recognized as forming a binding contract between the BSC and those BSC employees.
B. If any part of this contract is declared/rendered invalid by existing or future legislation, the invalidation of the part shall not invalidate the whole, and the other parts shall remain in effect. The Employees and the BSC agree that the contract may be reopened by either party upon 30 days written notice for negotiations over the invalidated part(s).
C. This contract shall run from January 1, 2008 through December 31, 2012.
D. At any time, one party may request to re-negotiate specific terms of the contract. In this event, both parties must confer and respond within 15 days of receiving a request to re-negotiate. Only changes which result in no net financial change to this contract may be made at this time.
E. Interpretation of this contract shall be subject to the grievance procedure stated in Section 17.B.6 below.
